Community Rules & Regulations

Based on the Declaration of Condominium for Lago Grande Three-A, recorded in the Public Records of Miami-Dade County, Florida, and Florida Statutes Chapter 718 (the Condominium Act)

1. Use of Units

  • Units must be occupied only as private dwellings by Unit Owners, their approved tenants, members of their families, and their social guests, and for no other purpose.
  • If a Unit is owned by a corporation, partnership, trust, or other entity, it may only be occupied by persons approved in writing by the Association.

2. Conduct and Compliance with Law

  • No immoral, improper, offensive, or unlawful use may be made of any Unit, the Condominium Property, or the Common Elements.
  • All Unit Owners, tenants, and guests must comply with all applicable laws, zoning ordinances, and governmental regulations, as well as all Rules and Regulations adopted by the Association.
  • Nothing may be done or kept in a Unit that would increase the Association's insurance premiums or interfere with the rights of other Unit Owners.

3. Exterior Alterations and Common Elements

  • Nothing may be affixed, hung, displayed, or placed on the exterior walls, doors, balconies, or windows of any Unit without the prior written consent of the Board of Directors, and no business, trade, or profession may be conducted from within a Unit without the Association's prior written consent.
  • No clotheslines or similar devices are permitted anywhere on the Condominium Property. Balconies may not be enclosed, and exterior storm doors or shutters may not be installed without prior written Association approval.
  • A Unit Owner who retains a contractor is responsible for obtaining the Association's approval before work begins and is liable for any damage the contractor causes to the Condominium Property.

4. Flooring

  • No flooring may be installed in a Unit other than carpeting, kitchen vinyl or tile, and bathroom tile.
  • Carpeting that is removed must be replaced within fifteen (15) days unless the Association gives prior written consent otherwise.

5. Common Hallways and Storage

  • Common hallways and passageways must be kept clear for their intended use and may not be used for storage, temporary or permanent.

6. Trash and Garbage

  • All garbage and trash must be placed only in the disposal facilities the Association provides for that purpose.

7. Noise

  • All occupants must exercise care to avoid noise — including from musical instruments, radios, televisions, and amplifiers — that could disturb occupants of other Units.

8. Occupancy Limits

  • No Unit may be permanently occupied by more than two persons per bedroom.

9. Exterior Appearance

  • The Association determines the exterior color scheme of the Units and Common Elements, subject to the approval of the Homeowners' Association's Architectural Review Board.

10. Pets

  • Permitted pets are dogs and cats not exceeding fifteen (15) pounds, and birds and fish.
  • Dogs may be walked only in the designated pet-walking area established by the Board of Directors, and all cats and dogs must be kept on a leash outside of Units.
  • No animals may be raised on the Condominium Property for commercial purposes.
  • Unit Owners are financially responsible for any soiling or damage to the building, grounds, or Common Elements caused by their pet, and must pay all costs of cleaning or repair.
  • If a pet causes noise, damage, or reasonable complaints from other Unit Owners, the Unit Owner must board the pet off the property at the Owner's expense.

11. Parking

  • At least one parking space is assigned to each Unit.
  • All unassigned parking spaces are for the exclusive use of guests, employees, and invitees of the Unit Owners.

12. Leasing

  • A Unit Owner who wishes to lease a Unit (or an approved tenant who wishes to sublease) must give the Association a copy of the proposed lease and the name of the proposed tenant. The Association has fifteen (15) days from receipt to approve or disapprove in writing; failure to respond within that period is deemed an approval.
  • Individual rooms may not be rented, transient tenants are not permitted, and all leases must be for a minimum term of three (3) months.
  • The Owner or tenant seeking approval is responsible for the Association's reasonable processing expenses, up to $50.00; no charge applies to a lease extension or renewal.

13. Sale or Transfer of Units

  • The Association has a right of first refusal on the sale of a Unit; an Owner who receives a bona fide offer to sell must submit it to the Association, which has thirty (30) days to accept the offer (itself or through a designee) or to waive its right and consent to the sale.
  • Transfers by gift, inheritance, or operation of law must be reported to the Association within thirty (30) days, and the Association has sixty (60) days to approve the transferee or to offer to purchase the Unit at fair market value.
  • These approval requirements do not apply to transfers to a Unit Owner's spouse, children, parents, or siblings, or to those of the Unit Owner's spouse.

14. Mortgages

  • A Unit Owner may not mortgage a Unit without the Association's approval, except in favor of an institutional lender or a purchase-money mortgage taken back by the seller on a sale under the Declaration.

15. Owner Responsibility and Enforcement

  • Unit Owners are responsible for any damage to the Common Elements or Limited Common Elements caused by their own negligent or intentional acts, or by those of their tenants, guests, invitees, or employees.
  • If a Unit Owner violates or threatens to violate the Declaration or these Rules and Regulations, the Association may seek injunctive relief in a court of equity and may impose and collect fines for the violation.

16. Additional Rules

  • The Board of Directors may adopt additional rules and regulations it deems necessary or appropriate for the comfort, safety, and welfare of Unit Owners, or for the preservation and enhancement of the Condominium Property, consistent with the Declaration, the By-Laws, and Chapter 718, Florida Statutes.
